Terms of Use

PassTheKeys is a free marketplace for lease transfers (art. 264 CO). These terms set out what the platform does, what is free, the optional paid services, and the rules that apply when you use it. By using PassTheKeys you agree to them.

1What PTK is

Pass The Keys (PTK) is an online platform that connects outgoing tenants with incoming tenants for the transfer of a lease. PTK structures listings, contact, and matching; it does not select tenants, negotiate leases, or represent landlords. Every final decision rests with the landlord or régie.

2Free access, always

Listing, searching, matching, contacting the other party, applying, and closing a transfer are free for both sides — permanently. A departing tenant never pays to list. Access to the marketplace is never behind a paywall.

3No success fee, no commission

PTK never charges a commission for obtaining an apartment and never takes a share of any arrangement between tenants. PTK is collect-only: it does not pay the outgoing tenant a sum for the transfer. Your right to an early lease transfer (art. 264 CO) is never monetised.

4Optional paid services

Some optional services may carry a flat fee that is always shown to you upfront, before you commit: dossier verification, which turns your documents into a reusable verified status, and professional tools for owners and agencies. These are convenience and verification add-ons — they never gate access to a listing or to the transfer itself, and paying is never a condition of obtaining a flat.

5Your account

You need a verified email address to use the platform. You are responsible for keeping your credentials safe and for the accuracy of the information and documents you submit. You may delete your account at any time.

6Your content and documents

You keep ownership of what you upload. You grant PTK only the permissions needed to run the service — to store, process, and display your listing and dossier to the parties involved. How your documents are protected and shared is described in the Privacy Policy.

7Acceptable use

Use the platform honestly: do not misrepresent yourself or a property, post unlawful or discriminatory content, attempt to bypass verification, scrape the service, or disrupt its availability. We may suspend or remove accounts that break these rules.

8Listings and review

Every listing is reviewed before it goes live. PTK may decline, edit, or remove a listing that does not meet the listing guidelines or the law. Publication is not an endorsement.

9Role of the landlord or régie

The selection of the incoming tenant rests entirely with the landlord or régie, who may refuse any candidate. PTK does not guarantee a visit, a placement, or any particular outcome.

10Availability and changes

The service is provided as is, and we may add, change, or withdraw features. We may update these terms as the platform evolves; the current version always lives at this address, and continued use means you accept the update.

11Liability

PTK is not responsible for listings, for the conduct of users, or for the decisions of landlords and régies. To the extent permitted by Swiss law, our liability is limited to direct damage caused by our own gross negligence.

12Data protection

We process personal data as described in our Privacy Policy, under the Swiss nFADP and, where it applies, the GDPR.

13Governing law

Swiss law applies. The place of jurisdiction is Geneva, subject to any mandatory forum that protects consumers.
